Darren Finnegan (Prosecuting) Upholds Conviction in Life Changing Injury Driving Appeal

At Preston Crown Court, Darren Finnegan successfully upheld the conviction of a defendant who had been convicted of dangerous driving causing serious injury. The incident occurred on 7th June 2022 in the area of Whitworth. A car, driven by the defendant attempted to overtake another vehicle which had been turning right in a built-up area. The collision between the two vehicles had sent the defendant’s car careening across the road, crashing into the victim and crushing him against a wall. The victim had suffered significant and life-changing injuries. The impact, between the car and the wall, had caused open comminuted fractures to his tibia and fibula. Regrettably, he continues to suffer significant limiting effects of this collision and remains unable to walk.

Having been convicted at Burnley Magistrates’ of dangerous driving causing serious injury, the conviction and sentence imposed by the Magistrates’ was appealed by the defendant to the Crown Court. At an appeal hearing over two days, Darren Finnegan prosecuted the appeal. The defendant failed in her appeal and was sentenced to a custodial sentence of 12 months suspended for 24 months, a community order along with a 12-month disqualification and a requirement to sit an extended driving test.
