Richard Dawson represented six separate drivers from one firm who, together with other drivers (who had since been dismissed by the firm for misconduct) had all been called to driver conduct hearings.
Each of the drivers were accused of multiple infringements (driving without a driver card; swapping driver cards; pulling their cards), plus driving without the required CPC.
In the majority of cases, Richard was able to demonstrate that the failings had been either wrongly identified or had been wrongly attributed to individual drivers.
Moreover, while admitted in principle, evidence was produced to show that the drivers had been tricked into participating in CPC training that was being conducted by a fraudulent training provider, resulting in the CPC discrepancies.
Following the driver conduct hearings, the CPC training issues and the fraudulent trainer have been taken up by DVSA for further investigation.
The Traffic Commissioner reserved judgement on the drivers, pending resolution of the public inquiry into their employer operator. Decisions were recently announced, with each driver receiving only a short suspension from driving large goods vehicles.
