Sarah Magill and Kimberley Obrusik, Instructed By Jonathan Lynch of Lynch Law, Defend British Army Officer Acquitted at Court Martial
Sarah Magill led Kimberley Obrusik in the retrial Court Martial of a British Army Officer prosecuted for a sexual assault alleged to have occurred several years prior.
The case benefitted significantly from specialist military solicitor, Jonathan Lynch‘s trademark meticulous preparation, including the presentation of evidence from a devolved jurisdiction, weather evidence and the amalgamation of extraneous supportive military defence evidence.
Sarah first defended the officer at Court Martial that concluded with a hung Board. The Service Prosecution Authority determined to pursue a retrial, and Kim joined the defence team as a highly experienced junior, ensuring a seamless approach which involved cross-examining in transcripts from the first trial.
The defendant was acquitted by the Court Martial Board within two hours, bringing an end to a long period of uncertainty and stress.
