Andrew Thomas KC & Rachel Adamson Make Successful Application to the CCRC in Landmark EURIBOR Case
The CCRC has announced today that it is referring the case of Colin Bermingham and four other city traders to the Court of Criminal Appeal, following the decision of the Supreme Court in Hayes and Palombo.
Colin Bermingham’s conviction arose out of a prosecution by the SFO concerning the alleged submission of false figures to the EURIBOR reference rate process. It mirrored other prosecutions relating to LIBOR.
The CCRC concluded in their announcement:
“After analysing the submissions in all five cases and reviewing the directions in the context of the Supreme Court judgment, the CCRC has determined there is no distinguishing factor between these cases and the cases of Mr Hayes and Mr Palombo, and the jury misdirection and legal errors have undermined the safety of all the convictions.”
