Court of Appeal Rejects Bid to Increase Sentence

The Court of Appeal Criminal Division has rejected an appeal to increase a sentence imposed on a Blackpool woman responsible for the death of her daughter.

Elaine Clarke, aged 50, had received a sentence of 9 years 7 months, following a plea of guilty for an offence of manslaughter.

The sentence had been imposed by Mrs Justice Yip on 24th February 2022 at the Crown Court at Preston.

On 19th May 2022 the Court of Appeal rejected an application to appeal brought by HM Solicitor General that the sentence was unduly lenient.

The Court found that there were no arguable grounds to challenge the approach taken by the sentencing judge.

Tim Storrie QC and Sharon Watson, of 15 Winckley Square, Preston, instructed by Kathryn Jamieson Sinclair of Roland Robinson and Fentons, Solicitors, Blackpool, appeared for the Respondent, Elaine Clarke.
