Darren Finnegan Secures Low Sentence for Driver and Company Convicted for Using an Overweight Goods Vehicle.
Darren, instructed by specialist road traffic solicitor, Frank Rogers, represented both a company and its driver who were accused of using a goods vehicle when overweight. The vehicle was found to have been overweight by 52%.
Guilty pleas having been entered along with mitigation from Darren, the court imposed a fine of £1666.
The guidelines for these offences when sentencing profitable companies can be punishing. For Darren’s client, the guidelines suggested a fine of £22,849 after trial.
After mitigation and pressing upon the court the importance of a proportionality assessment of fine to reflect the gravity of the offence, the court imposed a fine of £1666 and secured a £127 fine for the driver of the vehicle.
