Lincoln House Chambers has an enviable reputation in the field of health and safety enforcement and the members of our specialist health and safety team are regularly instructed in some of the most high profile cases throughout the country. We are able to draw on the skills and experience of a number of King’s Counsel and Senior Junior Barristers who are recognised as leaders in their fields in health and safety areas.
We regularly act for companies, directors, and individuals in relation to criminal proceedings arising from alleged breaches of health and safety legislation. We also act for the HSE, local authorities, and CPS in relation to the prosecution of health and safety offences and a number of the team are members of the Attorney General’s list of specialist advocates in health and safety law.
Our members pride themselves on providing a first class service throughout all stages of health and safety prosecutions. We are able to advise on pre-charge and investigatory matters, fee for intervention, and responses and appeals, to improvement and prohibition notices.
In addition, our members provide representation and advice to directors, individual employees, companies and family members at inquests following work related deaths (please see the dedicated Inquest section of this website).
Our members are regularly instructed to appear in the Crown Court and Magistrates’ Court in cases involving allegations of:

- Gross negligence manslaughter
- Breach of sections 2 and 3 of the Health and Safety at Work Act 1974
- Breaches of the Regulatory Reform (Fire Safety) Order 2005
- Breaches of health and safety regulations including:

- -The Control of Vibration at Work Regulations 2005
- -The Control of Asbestos Regulations 2012
- -Gas Safety (Installation and Use) Regulations 1998
