Georgia Faulke & Michelle Man Secure SSO for Client in Multiple Sexual Offence & SHPO, SSO and Community Order Breach Case

Georgia Faulke instructed by Michelle Man at Draycott Browne Solicitors, defended a man in relation to two case files, comprising a total of 13 new offences. These included six offences involving breaches of a Sexual Harm Prevention Order (SHPO), image offences, attempted sexual communications, and simple possession of Class B drugs.

Georgia prepared a detailed mitigation note, setting out a clear chronology of events and addressing the delay in prosecution. Particular attention was given to the fact that the image and sexual communication offences pre-dated both a suspended sentence order (SSO) and community order imposed early last year. Careful consideration was also given to any potential overlap, as the offences for which the previous SSO had been imposed also involved image and sexual communication offences.

The Judge accepted that the Defendant ought to have been sentenced for the image and sexual communication offences at the same time that the original SSO was imposed.

The breaches of the SHPO and the simple possession offences occurred after the imposition of the SSO. However, Georgia Faulke made careful and considered submissions regarding the Defendant’s compliance with the previous order, his mental health, and the significant efforts he had been making to turn his life around.

Having considered those submissions, HHJ accepted the mitigation advanced. The Defendant was sentenced to 20 months’ imprisonment, suspended for two years. The previous SSO was varied to include a further 50 hours of unpaid work, and five additional days were added to the community order.
