Graham Rishton (instructed by Rees Clayton Solicitors) secured his 9th acquittal in 10 defence trials since joining Chambers in 2022.

The case involved the defence of a 50 year old lady of good character who had been accused of ABH, Criminal Damage and Possession of an Offensive Weapon.

The prosecution alleged that the Defendant had attended the home of a friend, armed with a large, baseball bat-sized, pestle intending to assault a former friend in a fall out over a debt. After arriving at the property, the complainant had been struck over the head and damage had been caused to various items within the living room.

Graham argued that Defendant’s intention, upon leaving her home address with the pestle secreted up her sleeve, had been only to intimidate so as to be able to make her escape from the complainant’s home, and that the complainant and her partner had, in fact, been the aggressors when the Defendant arrived at their home.

The jury took less than 15 minutes to acquit the Defendant of all charges.
