HMP Liverpool prison officers acquitted over inmate’s death

Peter Wright KC leading Kimberley Obrusik and Mark Ford KC leading Holly Nelson, instructed by Christian Harbinson of Thompsons Law, secured the acquittal of two prison officers charged with Gross Negligence Manslaughter and breach of the Health and Safety Act 1974.

The defendants were prison officers at HMP Liverpool and the case involved the death by suicide of an inmate in their custody. The defence from the outset maintained that the defendants had not breached any duty of care and had acted appropriately in all aspects of their involvement with the deceased.

Following cross examination of a number of Prison employees called by the prosecution, no evidence was offered prior to the close of the prosecution case. In doing so the prosecution conceded that there was no evidence that either defendant had breached the duty of care they owed to Mr Paine whilst he was in custody.
