Holly Nelson Prosecutes Defendant Company Fined £1 Million In Health & Safety Fatality Case
Holly Nelson, instructed by Chloe Ward of the Health and Safety Executive prosecuted Bestway Northern Limited in relation to a fatal accident at work which resulted in a fine of £1 million.
The defendant company was the employer of Mr Warburton who was sadly crushed by a reversing 18-tonne truck making a delivery in central Manchester in February 2019.
The HSE investigation revealed that the defendant company had failed to adequately provide banksman training, and other failings relating to risk assessments of reversing procedures and the site-specific issues present where the incident took place.
The sentencing Judge agreed with the submissions advanced by HSE on the guidelines, and the defendant company was considered by the sentencing Judge to be a “Very Large Organisation”.
The sentencing Judge concluded that the incident was “an accident waiting to happen”.
