Joe Allman and Caitlin Cardwell Secure Acquittal in “Hacked Computer” Defence Sexual Communications Case

Joe Allman, instructed by Caitlin Cardwell of Draycott Browne Solicitors, secured an acquittal in the incitement case following a three day trial at Manchester Crown Court.

Detailed cross-examination of the Crown’s digital media expert highlighted the presence of hidden malware on the client’s hard drive and both the expert, and detective in charge of the case, were further cross-examined by Joe Allman about digital artefacts and gaps in the investigation.

At the police interview the client denied being the user of the Skype profile which was used to communicate with the child, but at trial conceded the attribution of the profile and a hacking defence was advanced.

The client was acquitted on both counts by unanimous verdicts.

This case followed another successful defence trial for Joe & Caitlin. Another client who was charged with assault by penetration of a child was acquitted after Joe Allman’s cross-examination of the Crown’s DNA expert homed in on significant weaknesses concerning an intimate DNA sample.
