Following a four day trial in Preston Crown Court Neil Usher secured the acquittal of his client who was alleged to have raped a woman he met on Facebook. She told the jury he began raping her whilst she was asleep and that she was not sexually attracted to him. The defence was consent.The jury took just over one hour to acquit in a case where Neil successfully argued that the complainant’s sexual behaviour should be adduced pursuant to section 41.
