Successful claim for refund of service charge at the Leasehold Valuation Tribunal – Sergey Prokofiev represents direct access claimants.
[intro]Sergey Prokofiev successfully represented a Claimant in a contested hearing before the Manchester Leasehold Valuation Tribunal.[/intro]
The Claimants were the freehold owners of a property in Lancashire, and their claim was against the property’s management company and alleged various malpractices, including the lack of a contingency fund, and inefficient use of service charge contributions.
The case turned upon the true construction of the Lease to the property, according to which, the Respondents were charged with maintenance of common parts of the property, in return for which they were remunerated through the service charge.
Mr Prokofiev’s clients brought an action for the recovery of the service charge under Section 27A of the Landlord and Tenant Act 1985, based on the Management Company’s failure to observe their contractual Leasehold obligations.
The claim was successful and Judgment was in favour of the Claimants.
